Deed Restrictions

Paradise Hills is located within the city limits of Wimberley, TX, and is therefore governed by the City’s ordinances (including zoning) as well as by the use restrictions outlined in each property owner’s recorded deeds. The City enforces its zoning and ordinance particulars, and requires building permits for that purpose. However, if the City issues a building permit to you, that does not necessarily mean that your project also conforms to the deed restrictions for your specific property. Your property deed and restrictions are provided to you at closing by your Title Company, as either hard copies or via hyperlinks in the digital versions of your closing documents. You may also research filings for your property at the Hays County Clerk Records Division by in-person visit. Hays Online records search is also available, but it may not be useable to locate deed restrictions.

Deed restrictions in Paradise Hills are generally less restrictive than in many neighborhoods, however there are specific requirements for minimum square footage and architectural review (see FAQ page), to give two examples. You should familiarize yourself with your particular deed restrictions to avoid a violation which could result in a lawsuit against you.

Below are some examples of deed restrictions based on four sections within the Brinkley Tract of Paradise Hills–refer to your own specific deed restrictions to know the particulars for your property. Please note that some properties do not fall within a specific section plat, therefore those deed restrictions could vary significantly from the examples. Sections 3 & 4 have the same deed restrictions. Lots outside the Brinkley Tract will have different deed restrictions than the examples below.
