How do I join PHARA?
Go to the Contact Us page and send us a message requesting membership. You will then be sent and email invitation by which you can pay your initiation fee and dues online.
How do I pay my dues and get a new badge?
You may pay your dues online with a credit card by logging in to our member-only website if you are already a member, or by check mailed to Cliff Raymond, Badge Admin, 14 Meridian Drive, Wimberley TX 78676. Arrange with Cliff to either pick up your badge at his address, or have it mailed to you by mailing him a self-addressed, stamped envelope. Dues and badges are also managed at the annual member meeting that takes place each January.
Can I operate a short-term rental in Paradise Hills?
Short term rentals are not a permitted use for residential property in Paradise Hills, as per the City of Wimberley zoning regulations. Therefore, the owner must apply for a “Conditional Use Permit” (CUP) from the City. Historically, such permit applications have been overwhelmingly opposed by neighborhood residents. The CUP process includes:
- Complete the Application
- Remit Application Fee (non-refundable)
- The City then notifies those within 200’ of your application, publishes in the local newspaper and posts a sign on the subject tract
- After hearing from neighbors, Planning & Zoning will conduct a public hearing for recommendation and then a City Council hearing will occur for ultimate decision
NOTE: Per State & Local statute, if 20% of property owners within 200′ oppose the application a super majority vote is required by the Planning & Zoning Commission (6 out of 7) and City Council (4 out of 5) for approval.
Do I get access to the River Park if I join PHARA?
Membership in PHARA is voluntary and does not, in and of itself, enable access to the River Park. Please see the River Access page for details.
Is there a leash law and/or any regulations on nuisance behavior of animals?
Hays County has an Animal Control Ordinance, which, among other things, requires dogs to “be restrained at all times, by fence, chain or leash.” Click the link above for detailed information and phone number to report issues.
If you are a dog owner, please be considerate of your neighbors’ wellbeing and safety and keep your dog(s) restrained as required by the ordinance, whether they are at your home or with you on a walk. If you are a resident and are harassed or feel threatened by a loose dog, you may report the incident to the Hays County Animal Control office. The contact information is in the link above. They also ask that you take a photo of the dog to assist them with identification of the animal.
Also note that our River Park also has rules regarding leashing of dogs:
Dogs must be kept under their owner’s control while in the Park and within sight and sound of their owners at all times. An unleashed dog is not considered under the owner’s control if it poses a safety risk to other people or other dogs, it trespasses on adjoining private property without permission, or is a nuisance. In such circumstances the dog should be on leash. Please be courteous and pick up after your dog.
Who provides utilities for Paradise Hills?
- Water is provided by Wimberley Water Supply, a privately-owned company. Private wells are not permitted.
- Electricity is via Pedernales Electric Cooperative.
- Cable TV/Internet/Phone is available from Spectrum at most locations in the neighborhood.
- Landline phone service available through Frontier Communications
- Trash & recycling is by Texas Disposal Systems, not the City of Wimberley. Trash pickup is each Monday, recycling pickup every other Monday. You must set up an account with TDS.
- Septic requires a private septic system for each lot.
- Cellphone reception is variable due to hilly conditions, but available for all major carriers.
- Gas/Propane is available via private tanks, there are a number of providers in the area.
How do I have my building plans reviewed as required by my deed restrictions?
Architectural review authority was formally transferred from the Brinkley Interests corporation (original conveyor of deeds) to PHARA in 1998. Please email us with your contact information by using the website form. You will then be contacted by a representative of our Architectural Review Committee for further actions.
Does PHARA issue resale certificates?
Since PHARA is not a mandatory HOA, it does not issue resale certificates.
Who is responsible for street maintenance?
Since our neighborhood was incorporated into the City of Wimberley, our streets are no longer maintained by Hays County. Contact the Wimberley Public Works department at (512) 648-2405. From time to time, PHARA has hired contractors to perform work within the neighborhood when the City has refused to get involved.
I have a complaint about how my neighbor’s yard is kept (ie: junk cars, stagnant water, tall weeds, unsightly trash, etc.)
If you are unsuccessful in reaching an acceptable solution with your neighbor, the City of Wimberley has ordinances which address such issues. Consult the City Ordinances page and use the search feature to locate applicable ordinance(s). You can then call the Code Enforcement office at (512) 648-2405 to report the violation and request the City to take action. You might also consider drafting a letter, citing the ordinance(s) in violation with supporting photographs, and mail or hand deliver to the Code Enforcement officer and the City Administrator.
What can be done about a violation of my deed restrictions by a neighbor?
First, you should attempt to resolve such issues directly with your neighbor. Feel free to contact the PHARA board for advice and possible assistance, but keep in mind that because PHARA is not a mandatory HOA, it does not have the legal authority to directly enforce deed restrictions. Also, the City of Wimberley does not enforce deed restrictions, it only enforces its City Ordinances. Many violations of deed restrictions would also be a violation of a particular City ordinance, since there is a lot of overlap between the two. In that case, see FAQ on City Ordinance violations.
If you share the same deed restrictions as the violator, and you are unable to reach an acceptable resolution with your neighbor, as a last resort you could consider bringing suit against them in Justice of the Peace Court–the PHARA board may, at its sole discretion, elect to assist you as an interested third party.
When is it safe to trim my oak trees?
Oak Wilt can destroy our beautiful oak trees if an infestation begins in our neighborhood. So, in consideration of all of your neighbors, please do not trim or wound your oak trees from February through June when the insects that spread Oak Wilt are active.
